PART 1 INTRODUCTION
This website is operated by Ladbrokes International plc, ( "we",
"us", "" or " BETDAQ"). We
are a company registered in Gibraltar with number 46808 with a registered office at
57-63 Line Wall Road, Gibraltar.
We are licensed and regulated by the Gibraltar Gambling Commission, Licence
Number 010.
These terms and Conditions("Terms and Conditions")
govern your ("you", "your", " Customer")
betting activity with Ladbrokes International plc via this website ("BETDAQ Website").
You will not be able to open an account with us until you have confirmed that you
agree to be bound by these Terms and Conditionsas part of the registration
process.
All the following are components of these Terms and Conditions:
On the BETDAQ Website, we provide the following services (together, the "Services"):
- our betting exchange ("Exchange");
- MultipleBet;
(together the "Exchange Services"); and
- instant games, and other gaming products and services ("BETDAQ Games"
or "Games Service").
All Customer Accounts (as defined in paragraph 1 of part 2) are administered on behalf of Ladbrokes International plc,
by a third party, BDQ Member Funds. Any funds deposited by Customers are held by BDQ Member
Funds and a trust company from the wider Ladbrokes International plc group of companies, Ladbrokes Trustee
Company Limited. In these Terms
and Conditions(as the context may require) references to "BETDAQ",
"we", "us" or "our" means one or all of
Ladbrokes International plc, BDQ Member Funds and/or Ladbrokes Trustee Company Limited.
In the event of any inconsistency between any Parts of these Terms and Conditions
and Part 2 'Becoming a customer of BETDAQ', Part 2 'Becoming a customer of BETDAQ' shall prevail.
PART 2 BECOMING A CUSTOMER OF BETDAQ

1. ELIGIBILITY
Individuals
- 1.1 If you are an individual,
it is a condition of your opening an account ("Customer Account")
that you warrant and represent to us that you are over the age of 18 and that you
have the mental capacity to take responsibility for your own actions and can enter
into a legally binding agreement with us.
Companies and other entities
- 1.2 If not an individual,
it is a condition of your opening an account ("Customer Account")
and using the Services in the course of your business activities that you warrant
and represent to us that you are and will remain during the entire duration of your
using the Services, a licensed bookmaker or an entity entitled to utilise the Services.
If you wish to use our Services in the course of a business, you must inform us
of this during the application process by contacting us at [email protected].
- 1.3 If you are using the BETDAQ
Website in the course of your business activities you will determine if you require
any form of licence or authorisation. You will hold a valid licence or authorisation
to the extent that one is required.
- 1.4 In any event, if you use
the BETDAQ Website in the course of your business activities, then you are solely
responsible for accounting for any general betting duty which may become payable
on such activity. If you are in any doubt as to whether your betting activities
may constitute bookmaking (in any jurisdiction) and/or whether any general betting
duty is payable by you, you should obtain independent legal advice.

2. YOUR LOCATION
- 2.1 You may not participate
in our Services if you are resident in the United States of America and such other
territories as we deem "prohibited territories" from time to time.
- 2.2 Customers are responsible
for ensuring that they comply with any laws applicable to gambling in their country
of residence. We are not responsible for any action which may arise from participating
in our Services when in a country in which gambling may be illegal. You must not
access the BETDAQ Website and/or open a Customer Account from a location within a
jurisdiction that prohibits gambling.
- 2.3 We reserve the right,
for whatever reason and at any time, to close any Customer Account or suspend access
to the BETDAQ Website if Customers are found to be in breach of the warranties or
undertakings given above. We also reserve the right to block transactions that we
suspect are sourced from any prohibited territory at our discretion.

3. VERIFICATION
- 3.1 For an individual, you
consent to our undertaking an identity verification process, (otherwise known as
'Know your Customer' a "KYC" process) using the details such as
date of birth, address and other personal details we obtained from you during the
application process. These details may be checked against a variety of identity
databases in accordance with our Privacy Policy. We may also ask you for specific
proof of identification (such as a copy of your passport). At times we may further
use your information to pursue other checks of identity.
- 3.2 You are obliged to keep
your personal information up to date and you consent to further identity verification
checks on all changes to your personal information.
- 3.3 If your identity details
cannot be verified within the first 72 hours after applying to open a Customer Account
and depositing funds, we reserve the right to void any transactions placed during
that period and the Customer Account may be froze. For the Customer Account to be re-activated,
you will need to send us copies of any relevant identification documentation, as
we may request. If we are unable to satisfactorily verify your identity within a
reasonable time-period, we reserve the right to close your Customer Account and withhold
any funds held in your Customer Account (to be held until our verification process
is complete or subject to our Inactive Account Policy).
- 3.4 No winnings will be paid
to Customers who have not satisfactorily passed the KYC verification process.
- 3.5 For companies and other
entities, we may require disclosure of additional identity details including but
not limited to: Regulatory consents or licenses, director/partner identity documents,
articles of association, certificate of incorporation, written consent from an officer
of an entity that the entity is able to participate in the Services and any other
relevant document that we may reasonably request to ensure identity and consent
is achieved.
- 3.6 We reserve the right,
at our own discretion, to conduct checks against registered details of applicants
and Customers to ensure the accuracy of information provided and we shall be entitled
to demand further evidence as to an applicant's age, capacity to legally contract
with us, country of residence or any other information at any time in the future.

4. YOUR AGREEMENT WITH BETDAQ
- 4.1 You may not avail of any
Services until you have applied to join BETDAQ by completing the online
registration process on the BETDAQ Website and indicating your acceptance of the
Terms and Conditions. BETDAQ reserves the right to refuse any application
without any further correspondence or reason.
- 4.2 To apply to join
of BETDAQ, applicants must first complete the online registration process set out
on the BETDAQ Website. By clicking the "accept" icon on the BETDAQ Website as part
of the registration process, you indicate that you accept the Terms and Conditions
and you consent to be bound by and to become a party to them and all
of their contents (as each may be amended from time to time in accordance with their
terms) which governs your relationship with us.
- 4.3 Each Customer may have only
one Customer Account. We reserve the right to suspend Customer Accounts where we suspect
that Customer Accounts are duplicates.
- 4.4 Once registered, a Customer
is entitled by BETDAQ to participate in the Services subject always to these Terms
and Conditions.
- 4.5 If the applicants are
eligible to join of BETDAQ (with eligibility determined in accordance with
paragraph 1 above) and the application is successful,
they may open a Customer Account and transact with other Customers as described in these
Terms and Conditions.
- 4.6 As part of the application,
Customers will be provided with a PAN (personal account number) and can choose a username
and password. These must be kept confidential as all offers made or accepted using
these details will be treated by BETDAQ as valid provided they meet the other criteria
for making an offer contained in these Terms and Conditions. You understand
that you are liable for all transactions made using your Customer Account and that
we accept no responsibility for any misuse of your password by any third party.
- 4.7 Each Customer is responsible
for regularly reviewing their Customer Account details which are contained in the
BETDAQ Website under "My Account". If you become aware of any inaccuracies in transaction
or contact information you must inform BETDAQ as soon as possible.

5. THE ROLE OF BETDAQ AND BDQ
MEMBER FUNDS
- 5.1 The role of BETDAQ is
to act as a facilitator between Customers who wish to make offers to each other. These
offers, if matched or partially matched, will become contracts between individual
Customers.
- 5.2 The role of BDQ Member
Funds is to act as stakeholder for Customers' funds and to provide Customers with a
funds-settlement service for the settlement of those contracts.
- 5.3 We do not enter into the
matched contracts between Customers nor do we bear any of the risk inherent in contracts
between Customers. Our income derives from commission earned from Customers for facilitating
the matching of offers with other Customers and providing them with a funds-settlement
service. Our income does not depend on the outcome of events upon which contracts
are struck between Customers.
- 5.4 In consideration of our
acting as a facilitator for Customers transacting with one another we charge a commission.
Please refer to Commissioncontained in the "Help" section of the BETDAQ Website
for more information regarding calculation of commission. We reserve the right to
amend our commission policy from time to time.

6. FUNDING AND WITHDRAWALS
- 6.1 Customers may place funds
in a Customer Account using deposits section and following instructions as may be
outlined on the BETDAQ Website from time to time.
- 6.2 To assist in the timely
and successful transfer of funds to and from your Customer Account the Customer should
note carefully and follow the instructions that are given within the deposits section
of the BETDAQ Website.
- 6.3 The name and billing address
on the credit card, debit card, bank account or other payment method through which
a Customer transacts with BETDAQ should be the same as the Customer's registered name
and address. Payments via third party debit cards, credit cards, bank accounts or
any other payment method which are not registered to the Customer will not be accepted.
- 6.4 All transactions with
us are denominated in British Pounds Sterling ("£"), Euro
("€"), $ US Dollar ("$USD"), and $ Singapore
Dollar ("$SGD").
- 6.5 For lodgements in currencies
other than the currency of the Customer's Account, BETDAQ will credit the Customer's
Account with the amount as settled by its bank.
- 6.6 The minimum deposit into
your Account is £/€/$USD/$SGD10 or currency equivalent where relevant.
- 6.7 BETDAQ do not impose a
maximum withdrawal limit but withdrawal limits may be imposed by our payment providers,
which may be subject to change and be updated from time to time. Withdrawals may
also be subject to internal risk reviews.
- 6.8 Any funds deposited by
Customers are held by BDQ Member Funds and/or Ladbrokes Trustee Company Limited, and are therefore
segregated from Ladbrokes International plc own corporate funds.
- 6.9 Neither the balance held
in a Customer Account nor any funds held by BDQ Member Funds or Ladbrokes Trustee Company Limited shall bear interest.
- 6.10 Except for instances
where certain payment providers do not allow for withdrawals, monies may only be
transferred back to the originating source of the funds deposited.
- 6.11 Further to paragraph
3 of this Part 2, you will not be able to withdraw funds from your Customer Account
until your identity details have been submitted and fully validated in line with
our KYC process or as otherwise required in respect of our regulatory obligations.
- 6.12 BETDAQ reserves the
right to restrict withdrawals from a Customer Account where the Customer Account is
the subject of an internal or external investigation with respect to any suspicious
or fraudulent activity.
- 6.13 Promotional amounts
that have been credited to your Customer Account by BETDAQ may only be used for participating
in the Services and may not be withdrawn. Such promotional amounts may be subject
to a separate set of terms and conditions.

7. ACCOUNT FEES
- 7.1 There may be costs relating
to the transfer of funds into or out of Customers' Accounts which, wherever possible,
will be notified to the Customer in advance of his/her agreement to proceed with a
transfer instruction.
- 7.2 In the case of bank transfers,
to or from your Customer Account, Customers are responsible for all bank charges and
it may not be possible for us to inform Customers of the costs which they will incur.
Customers should confirm these costs directly with their bank before initiating such
transactions.

8. CLOSING CUSTOMER ACCOUNTS
- 8.1 You have the right to
close your Customer Account at any time. To close your Customer Account you must write
to us via e-mail, fax or letter, using our "Contact Us" section.
- 8.2 We reserve the right to
close or suspend your Customer Account at any time and for any reason. We will give
you notice before doing so, unless circumstances dictate that we legally or practically
cannot do so.
- 8.3 If outstanding offers
form part of the balance on a Customer Account such funds will not be released until
the offer has lapsed at the actual time of the event or the offer is cancelled or
voided in accordance with these Terms and Conditions, or until the
offer is matched and the outcome of the contract between the Customers is known, or
until any dispute regarding the funds is resolved.

9. INACTIVE ACCOUNT POLICY
- 9.1 For security reasons,
BETDAQ reserves the right to suspend your Customer Account without giving prior notice
if no log in or log out has been registered on your Customer Account for 12 consecutive
months.
- 9.2 Where your Customer Account
is in credit but has been suspended under paragraph 8.4 of Part 2, BETDAQ will make
reasonable efforts to inform you that there are funds remaining in your Customer Account.
You will be able to re-activate by contacting us at [email protected]. You may
be required to re-submit your identity details before your Customer Account can be
re-activated.
- 9.3 If no log in or log out
has been registered on your Customer Account for 24 consecutive months and after reasonable
efforts to contact you have been exhausted, your entitlement to your funds will
be deemed to be extinguished and your funds will be donated to an appropriate charity.
BETDAQ may, at its own discretion, refund any deductions made under this Inactive
Account Policy.

10. MAKING AN OFFER ON THE
EXCHANGE
- 10.1 To enter into a contract
with another Customer(s), a Customer must first make an offer on any event listed in
the Exchange stating the terms on which he or she wishes to transact, e.g. event,
the selection, outcome, stake and minimum price they are willing to accept.
- 10.2 Customers will only be
permitted to make offers using funds ("Stake") up to the amount
of the current available balance in their Customer Account.
- 10.3 BETDAQ may increase
or decrease the minimum Stake at any time.
- 10.4 When an offer is made
by a Customer, BETDAQ will act as stakeholder and agent of the Customer.
- 10.5 The Exchange will attempt
to find opposing Customer offers that have unconditionally been entered into the Exchange,
ie those which express an opposing view at equivalent terms or better, which have
not yet been matched.
- 10.6 Once the Exchange has
found such an opposing unmatched offer, it will automatically match the two Customers'
offers and those Customers will have entered into a contract with each other on the
terms stated in their opposing offers. This is a binding agreement from which it
will not be possible for the Customers to choose to exit and the terms of which they
cannot amend.
- 10.7 Customers may only make
an offer on events for which there is a market open on the Exchange.
- 10.8 Customers may request
that markets be opened on new events on the BETDAQ Website by emailing BETDAQ. BETDAQ
is under no obligation to open new markets.
- 10.9 Customers may only make
an offer in the currency in which their Customer Account is denominated.
- 10.10 With all offers placed
over the telephone Customers are required to clearly state their PAN (personal account
number) and surname, followed by your offer request to the operator. The operator
will repeat the Customer's offer request back to them. This may cause a slight delay
in placing an offer but is essential to ensure order instructions have been correctly
understood. It is the Customer's responsibility to ensure that the operator has correctly
interpreted his/her instructions. BETDAQ will not be responsible for any orders
incorrectly communicated to the operator by telephone. Offers placed by telephone
will not be processed if the phone call is interrupted before the operator can confirm
to the Customer that the order has been placed. All telephone calls are recorded.
- 10.11 For offers made after
an event has commenced but before the event has completed and betting on the event
has been suspended, ("in running") there is a built-in delay for
processing offers. Depending on the sport this could be up to 10 seconds. Customers
must wait for confirmation after the delay that their offer has been placed.
- 10.12 Customers are responsible
for offers placed on their Customer Accounts where correct PANs, surnames, usernames
or passwords are used to access the Customer Accounts by telephone or the BETDAQ Website.
- 10.13 The current minimum
Stake for an offer placed by a Customer on the Exchange is £/€/$USD/$SGP2.
This minimum Stake can be amended by BETDAQ without notice at any time.
- 10.14
BETDAQ reserves the right to impose a minimum stake on offers placed via our TeleBet service.
This stake can be amended by BETDAQ without notice at any time.
- 10.15 When a Customer delivers
or makes an offer into the Exchange, the Customer grants to BETDAQ an irrevocable
authority:
- 10.15.1 to accept, on
behalf of the Customer, any other Customer's previously recorded corresponding and opposing
offer and thus to create a matched offer or contract between the Customers; or
- 10.15.2 failing (i), to
display the terms of the Customer's offer for acceptance by other Customers until the
offer is accepted by (an) other Customer(s) or until the offer expires.
- 10.16 BETDAQ will provide
Customers with an order number in respect of each of their placed offers.
- 10.17 Once an offer has
been submitted, BETDAQ will instruct BDQ Member Funds to provide a funds-clearance
service for the transaction in the following way:
- 10.17.1 immediately upon
a Customer submitting an offer into the Exchange, BETDAQ will instruct BDQ Member
Funds to debit the Stake from the Customer's Account in accordance with the terms
of the offer. The total proposed Stake to be deducted will be notified to the Customer
before he/she finally places the offer.
- 10.17.2 BDQ Member Funds
shall hold the relevant funds so as to ensure that the funds are not used for any
other purpose until the offer is unmatched and has expired at the stated time for
the event, is cancelled or voided or until the offer is matched and the undisputed
outcome of the contract between the Customers is known.
- 10.17.3 if the offer is
matched or partially matched then, upon settlement of the contract in accordance
with the BETDAQ Rules, we will distribute the Customers' Stakes according to the applicable
rules of the contract agreed between the Customers, less our commission.
- 10.17.4 in the event that
an offer is not matched by the Exchange, it will either expire at the actual start
time of the event on which the offer is made or, if the Customer so specified, be
carried over to be offered in the in running market. Upon expiry, the Stakes offered
that are not matched, or are deemed void, will be returned to the respective Customers'
Accounts.
- 10.18 BETDAQ bears no responsibility
for monitoring and managing the status of Customers' offers. Offers may not get matched,
may get partially matched or get fully matched. Customers are responsible for monitoring
how much, if any, of each of their offer is matched.
- 10.19 Programs may be used
by some Customers in order to automatically make offers into the Exchange and enter
into binding contracts with other Customers based on certain specifications and variables
set within the program ("Bots"). Customers, whether they use Bots
or not to make offers on the Exchange, should be aware that any offer could be susceptible
to exploitation by other Customers.

11. OFFER CANCELLATION
- 11.1 BETDAQ will use all
reasonable endeavours to meet offer cancellation requests.
- 11.2 No cancellation of an
offer will be effective until the original offer is removed from the Exchange and
no longer displayed on the BETDAQ Website.
- 11.3 As an offer is available
to other Customers until cancelled there is the possibility that an offer may be accepted
and matched in the Exchange before the cancellation request can be completed. BETDAQ
bears no responsibility for delays which may arise between the time a cancellation
order is initiated and the time it is actually cancelled.
- 11.4 BETDAQ reserves the
right to close the Exchange at any time, in order to preserve orderly markets or
for any other reason deemed fit by BETDAQ.
- 11.5 BETDAQ reserves the
right to prevent Customers' offers being entered onto the Exchange, cancel any outstanding
offers or void any outstanding or settled contracts between Customers at our absolute
discretion and with no obligation to provide Customers with any reasons for so doing.
- 11.6 Without restricting
our ability to rely on other remedies that may be available to us, we may cancel
any unmatched offers using the Exchange or other Services or void any contracts
at our absolute discretion if:
- 11.6.1 we suspect that
Customers are acting other than on their own behalf or otherwise in concert with others
or engaging in illegal or fraudulent activity while using the Services;
- 11.6.2 we suspect that
Customers are breaching any terms of these Terms and Conditions;
- 11.6.3 we suspect that
Customers are acting in a manner that is detrimental to the conduct of BETDAQ's business;
- 11.6.4 we suspect that
it is illegal for a Customer to participate in the Services;
- 11.6.5 we are unable to
verify registered address or contact telephone number; or
- 11.6.6 we are required
to do so by law.
- 11.7 All void contracts and
cancellation of offers will have the Stakes refunded.

12. SETTLEMENT
- 12.1 All contracts are settled
subject to the BETDAQ Rules.
- 12.2 We reserve the right
to correct errors of settlement. If, following correction of a mis settlement, the
balance on a Customer's Account becomes negative, the Customer will immediately deposit
sufficient funds into his/her account to increase the balance to an amount at least
equal to zero.
- 12.3 We reserve the right
to recover from Customers any Stakes paid out in error or which become the subject
of a disputed contract. Any Stakes that become subject of a disputed contract will
be placed in a holding account pending resolution of the dispute in accordance with
our Complaints Procedure and Dispute Resolution Policy.

13. WARRANTIES BY YOU TO BETDAQ
- 13.1 You warrant to BETDAQ
the following:
- 13.1.1 that you are fully
and legally entitled to enter into these Terms and Conditions;
- 13.1.2 that you have full
authority to execute these Terms and Conditions;
- 13.1.3 that your entering
into these Terms and Conditions is not illegal in your jurisdiction
of residence and you will not use any Services while resident or temporarily located
in any jurisdiction that prohibits the use of such services;
- 13.1.4 that you will take
full responsibility for reporting any winnings and/or losses to any relevant tax
or other authorities;
- 13.1.5 that, if an individual,
you are over 18 years of age;
- 13.1.6 that, if you are
a corporate entity, your participation in the Services is permitted under your articles
of association;
- 13.1.7 that you will not
open another BETDAQ Customer Account or access any other BETDAQ Customer Account or
attempt to use any of the Services or BETDAQ Games for which you have self-excluded
and for the duration of any self-exclusion;
- 13.1.8 that you are acting
as a principal and not as an agent on behalf of a third party;
- 13.1.9 that you are not
and never have been an undischarged bankrupt or in a voluntary arrangement with
your creditors;
- 13.1.10 that, if you are
a bookmaker, your participation in the Services is not contrary to the terms of
your bookmaking licence;
- 13.1.11 that, if you are
a bookmaker, these Terms and Conditions over-ride the terms and conditions
of your own business;
- 13.1.12 that all details
provided by you to BETDAQ are accurate and that you will not take steps to conceal
your true identity from BETDAQ such as by using pseudonyms, false addresses or taking
technical steps to conceal your identity or location;
- 13.1.13 that you are the
authorised Customer of any payment method you use on BETDAQ and that you have never
failed to honour a liability on a bet by attempting to charge back a payment made
by card for betting services.
- 13.2 You understand that
participating in the Services is speculative in nature and therefore contains a
degree of risk. You acknowledge that you are fully prepared financially to undertake
such risks and to withstand any losses incurred, and that you are able to sustain
the total loss of any Stakes committed by you.

14. INDEMNITIES BY YOU TO BETDAQ
- 14.1 You agree to indemnify
and hold Ladbrokes International plc, BDQ Member Funds, Ladbrokes Trustee Company Limited
and each of those companies' respective holding
companies and any subsidiaries, affiliates, officers, directors, agents and employees
of such holding companies or its subsidiaries harmless from any liabilities, claims,
losses or demands made by any third party arising out of your breach of these Terms
and Conditions or out of your violation of any law or the rights of
any third party.
- 14.2 You acknowledge that
BETDAQ and its subsidiaries and affiliates will hold information with respect to
your identity, including, but not limited to, your name, address and payment details.
You agree that we rely on this information in entering into these Terms and Conditions
with you and you agree to hold us harmless against any falsehood or
inaccuracy contained in the information you provide.
- 14.3 You agree to indemnify
us for any losses, costs or expenses which may be incurred by us as a result of
any errors contained in instructions submitted by you, any unauthorised or unlawful
use of the Services or any payment card charge-backs which may be effected for any
reason whatsoever on amounts transferred by you to your Customer Account.
- 14.4 If, through use of the
Service, a Customer causes BETDAQ to publish, whether on the BETDAQ Website, via email
or otherwise, potentially defamatory, illegal, obscene or offensive material, that
Customer agrees that he/she shall be solely liable for the publication of such material
and that he/she will indemnify BETDAQ for all costs, penalties, liabilities and
charges incurred by it in relation to such publication.
- 14.5 All amounts due under
the Terms and Conditions shall be paid by you to us in full without
any set-off, counterclaim, deduction or withholding (other than any deduction or
withholding of tax as required by law).

15. FRAUD, HACKING
- 15.1 The BETDAQ Website should
not be hacked into, altered or be compromised by Customers in any way. Any such behaviour
will lead to the closure of a Customer Account.
- 15.2 Any Customer who uses
the BETDAQ Website for criminal or fraudulent activities or to, directly or indirectly,
attempt to make or accept offers on behalf of any third party on the Exchange will
have his/her Customers Account terminated in accordance with clause 17.

16. COMPLAINTS AND DISPUTES
- 16.1 By "complaint"
we mean a complaint you have about any aspect of our conduct in relation to your
dealings with the Services and by "dispute" we mean either a complaint
or a disagreement relating to the Services or the outcome of a gambling transaction
on BETDAQ Games which are not resolved through the Complaints Procedure.
- 16.2 If you have a complaint,
you should in the first instance contact the Customer support team at [email protected]
where your complaint can be registered and recorded. Complaints should be made as
soon as possible after circumstances arise that cause you to have a complaint.
- 16.3 We are committed to
resolving any query or complaint about our products or services in an efficient
manner and we will use all reasonable efforts to resolve a Complaint promptly. If
for some reason you are not satisfied with our resolution of your complaint, you
have the right to escalate the matter as set out in our Dispute Resolution Policy
- 16.4 We reserve the right
to record all communications with you and any other person regarding complaints
or disputes. If there is a dispute as to the contents of any such communication,
reference will be made to such records and to our transaction database which, in
the absence of any contrary evidence, shall be decisive.
- 16.5 You are reminded that
under other provisions of these Terms and Conditions both you and
we have the right to close or suspend the operation of your Customer Account and that
this may happen whilst a complaint or dispute is pending.
- 16.6 You accept that any
complaint or dispute shall remain confidential both whilst a resolution is sought
and afterwards. You agree that you shall not disclose the existence, nature or any
detail of any complaints or disputes to any third party other than under the Dispute
Resolution Policy (which shall include the discussion of any such any complaints
and disputes in any chat room or forum offered by ourselves or any third party).
- 16.7 You accept that any
failure to comply with this confidentiality obligation is a breach of these Terms
and Conditions and that we reserve the right not to continue seeking
a resolution to your complaint or dispute.
- 16.8 Complaints Procedure
- 16.8.1 For the initial
phase of registering a complaint, we will investigate the matter in a manner that
is fair and objective and advise you of the outcome and/or our decision as soon
as we reasonably can. You may be required to provide additional information or appropriate
evidence for the purposes of dealing with your complaint.
- 16.8.2 If your complaint
is not resolved to your satisfaction at the initial phase you may request that the
matter be escalated and reviewed again. In this secondary phase, your complaint
will be referred internally to a senior manager (being the Head of Product of Ladbrokes Services (Ireland) Limited, our services company, or equivalent) who will conduct an independent review and present us with his/her findings. We will advise you of the outcome and/or our decision as soon as we reasonably can and we may have to ask you again for more information or appropriate evidence.
- 16.9 Dispute Resolution
Policy
- 16.9.1 All complaints that
cannot be resolved in either the initial phase or the secondary phase can be sent
forward to the relevant independent body to adjudicate in the dispute.

adjudicator to contact in the event of any dispute in relation to a bet utilising

- 16.9.4 Where a dispute
is referred to a regulator this will be dealt with according to the laws and dispute
resolution processes specified by such regulator and the resulting decision shall
be final and binding and you therefore will not have further recourse to the courts.
- 16.9.5 Where a betting
dispute is adjudicated by IBAS and in the event that the terms of the adjudication
remain unsatisfactory to either disputed party, the Gibraltar Gambling Commissioner may act as a final arbiter
in such circumstances and may issue a final adjudication. In all circumstances where
either the Gibraltar Gambling Commissioner or IBAS are unable to supply a ruling however, the matter will be
dealt with by our senior management, where their decision will be final. In the
event that a Customer has a dispute with one or more Customers, that Customer releases
BETDAQ (and its officers, directors, agents, subsidiaries and employees) from all
claims, demands and damages (actual and consequential) of every kind and nature,
known and unknown, suspected and unsuspected, disclosed and undisclosed, arising
out of or in any way connected with such disputes.

17. SUSPENSION AND TERMINATION
- 17.1 We reserve the right
to suspend and/or terminate a Customer's registration and Customer's Account at our
absolute discretion and with no obligation to provide Customers with any reasons for
so doing.
- 17.2 Without restricting
our ability to rely on other remedies that may be available to us, we will suspend
or terminate Customer Accounts or cancel any unmatched offers using the Exchange
or any of the Services or any unfinished game play using BETDAQ Games at our absolute
discretion if:
- 17.2.1 we suspect that
Customer are acting other than on their own behalf or otherwise in concert with others
or engaging in illegal or fraudulent activity;
- 17.2.2 we suspect that
Customers are breaching any terms of these Terms and Conditions;
- 17.2.3 we suspect that
Customers are acting in a manner that is detrimental to the conduct of BETDAQ's business;
- 17.2.4 we suspect that
Customers may be having difficulties obtaining credit;
- 17.2.5 we suspect that
it is illegal for a Customer to participate in the Services;
- 17.2.6 we are unable to
verify registered address or contact telephone number;
- 17.2.7 we suspect that
the BETDAQ Website has been hacked into, altered or compromised by Customers in any
way; or
- 17.2.8 we are required
to do so by law.
- 17.3 In the event that a
Customer's registration is terminated or suspended, we reserve the right to determine
whether to declare as void all contracts made by the Customer using BETDAQ and to
cancel unmatched offers by the Customer for the Exchange Services and/or to cancel
any incomplete gameplay for BETDAQ Games. We also reserve the right to withhold
funds from the relevant Customer where we suspect misuse of the accounts has occurred
and, further, reserve the right to donate such funds to a charity of our choice
if we ultimately close the Customer Account following any internal or external investigation.
If a Customer is a party to a contract with a Customer whose registration is terminated
or suspended that Customer consents to our right to declare void any such contract.

18. LIMITATION OF LIABILITY
- 18.1 Save in the case of
manifest error on our part, we accept no responsibility and shall not be liable
for any consequences that are alleged to have occurred through a Customer's use, or
misuse, of any of the Services.
- 18.2 Each Customer is entirely
responsible for the information that they provide to the Exchange concerning any
offer that they wish to place. We will not enquire into the reasonableness of any
offer that any Customer may make and we will not be liable for incorrect entries made
by Customers, including data input errors with respect to the odds or Stake on offer.
We will not be liable to Customers for any loss that Customers may incur as a result
of misuse of passwords, usernames, digital certificates or other identification
means accepted by BETDAQ from time to time and we accept no liability resulting
from any unauthorised use, whether fraudulent or otherwise.
- 18.3 The Services are provided
"as is" without any express or implied warranty of any kind including warranties
of merchantability, non-infringement of intellectual property, or fitness for any
particular purpose. In no event shall we be liable for any damages whatsoever including,
without limitation, damages for loss of direct or indirect profits, economic loss,
business interruption, loss of information) or any direct, indirect, consequential
or special losses howsoever caused including but not limited to any loss of contracts,
loss of goodwill and loss of reputation arising out of the use of or inability to
use the Services, even if we have been advised of the possibility of such damages.
- 18.4 To the extent permitted
by law, Ladbrokes International plc, BDQ Membmer Funds and Ladbrokes Trustee Company Limited
and their other associated companies and third parties
connected to them hereby expressly exclude all conditions, warranties and other
terms which might otherwise be implied by statute, common law or the law of equity;
and:
- 18.4.1 any loss incurred
in transmitting information to the BETDAQ Website;
- 18.4.2 any loss whatsoever
arising from the use, abuse or misuse of your Customer Account;
- 18.4.3 any technical failures,
system breakdowns, defects, delays, interruptions, manipulated or improper data
transmission, loss or corruption of data;
- 18.4.4 communication lines
failure (including any failures that affect the ability for interactive television
return-path capabilities), distributed denial of service attacks, viruses or any
other adverse technological consequence of your choosing to use our Services;
- 18.4.5 the accuracy any
information services provided (including, without limitation, scorers, runners,
times, results or general statistics) or any live scores, statistics and intermediate
results shown on the BETDAQ Website which are provided by third parties; or
- 18.4.6 any failure on our
part to observe any self-exclusion policies that you have put in place from time
to time with any Ladbrokes Group company.
- 18.5 Subject to the foregoing,
our maximum liability to any Customer howsoever arising shall be limited to:
- 18.5.1 in respect of the
Exchange Services, the amount of commissions actually received by us from that Customer
in the previous six months;
- 18.5.1.1 in respect of
BETDAQ Games, then: in case of liability relating to a specific bet, the amount
of the Stake beted; or in case of any other matter, notwithstanding valid payouts
£/€/$USD/$SGP10,000.
- 18.6 Nothing in these Terms
and Conditions affects our liability for death or personal injury
arising from our negligence, nor our liability for fraudulent misrepresentation
or misrepresentation as to a fundamental matter, nor any other liability which cannot
be excluded or limited under applicable law.

19. INTELLECTUAL PROPERTY
- 19.1 The information contained
on the BETDAQ Website is protected by world-wide copyright laws and treaty provisions.
It may not be copied, reproduced, modified, published, uploaded, posted, transmitted,
or distributed in any way, without our prior written permission. Except as expressly
provided herein, BETDAQ does not grant any express or implied right to Customers or
any person in any intellectual property rights, details of Customers or trade secret
information.
- 19.2 BETDAQ is the owner
or authorised user or licensee of all the intellectual property rights in the BETDAQ
Website including, without limitation, any copyright, patent, registered design,
trademarks, service marks, source codes, specifications, templates, graphics, logo(s)
or any right subsisting in Ireland or elsewhere in respect of formats, interfaces,
programming, the offering of services to other Customers, software or any application
for any of the foregoing and any modification, improvements, developments and enhancements
thereof.
- 19.3 Except as expressly
provided herein Customers or any other persons are not permitted to interfere with,
infringe or violate any intellectual property rights of BETDAQ or its licensors
and you agree not to interrupt or attempt to interrupt the operation of the BETDAQ
Website. BETDAQ shall seek legal redress to the fullest extent of the law against
any individual(s) or company(s) which interferes with, infringes or violates or
attempts to interfere with, infringe or violate any intellectual property rights
in the BETDAQ Website anywhere in the world. Subject to our Privacy Policy (see
Part 4 of these Terms and Conditions ) any Customer that posts data,
information, material or content on the BETDAQ Website shall give BETDAQ a worldwide,
royalty-free, sub-licensable, perpetual, irrevocable license to use, copy, reproduce,
link, modify, adapt, frame, brand, distribute and publish such data, information
or material on any media now known or later developed.
- 19.4 It is strictly prohibited
to use any price data or any other data or content from the BETDAQ Website without
our prior written consent.
- 19.5 Collection of any of
our data by means of screen scraping or any other automated or manual collection
by any Customer is strictly prohibited.
- 19.6 No links to the BETDAQ
Website are permitted without our prior written permission.

20. FORCE MAJEURE
- 20.1 We shall not be liable,
and shall not otherwise be deemed to be in breach of these Terms and Conditions
, for any failure to perform, or delay in performing, any of our obligations
hereunder caused by circumstances beyond our reasonable control including but not
limited to government or regulatory restriction, act of God, power cut, trade or
labour dispute, act failure or omission of any government or authority, the failure
of electronic or mechanical equipment or communication lines, telephone or other
interconnect problems (eg if a Customer or BETDAQ is unable to access his/her/its
online service provider), unauthorised access, theft, operator errors, severe weather,
earthquakes, floods and strikes or other labour problems. In such an event, we reserve
the right to cancel or suspend the Services or BETDAQ Games without incurring any
liability.
- 20.2 We will not be liable
for the failure of any equipment or software, wherever located or administered,
or whether under our direct control or not, that may prevent the operation of the
Services, impede the matching of offers, or prevent Customers from being able to contact
us.
- 20.3 We will not be liable
for any failure to perform by a third party to these Terms and Conditions.
In particular, we reserve the right to declare null and void any contracts that
the Exchange may not be able to settle because of non-performance by a third party.

21. CHANGES TO THESE TERMS
AND CONDITIONS, TO THE SERVICES OR TO THE BETDAQ GAMES
- 21.1 BETDAQ may amend these
Terms and Conditions at any time by posting the amended terms on the
BETDAQ Website. All amended terms shall automatically be effective immediately they
are posted on the BETDAQ Website. It is a Customer's responsibility to check these
Terms and Conditions from time to time to ensure that he/she agrees
with the terms. From time to time we reserve the right to agree individual amendments
to these Terms and Conditionswith certain Customers at our discretion.
The continuing use of the BETDAQ Website and the Services by a Customer following
such modifications to these Terms and Conditions shall constitute
acceptance of the new Terms and Conditions and Customers will be bound
by such modifications. If a Customer does not accept any such changes, then his/her
sole remedy is to cease using the Services and withdraw any outstanding Customer Account
balance. You should print a copy of these Terms and Conditions as
amended from time to time and retain it for your records.
- 21.2 BETDAQ reserves the
right to change the format of the BETDAQ Website and the Services themselves.

22. INVESTMENT BUSINESS UNDERTAKING
- 22.1 We are not authorised
to arrange contracts or transactions in investments or investment products or otherwise
conduct investment business.
- 22.2 Consequently, Customers
are prohibited from using the Services for the purposes of engaging in transactions
in investments or in any manner which would cause us to be considered to be arranging
transactions in investments or otherwise engaging in investment business. Accordingly
you undertake that, when using the Exchange, you will not deliver or make any offer
or series of offers which would (alone or together) if matched, create a "contract
for differences" (that is, intended by both parties to end in the payment of differences);
or rights under a contract for differences or under any other contract the purpose
or pretended purpose of which is to secure a profit or avoid a loss by reference
to fluctuations in (i) the value or price of property of any description or (ii)
in an index or other factor designated for that purpose in the contract; or cause
us otherwise to be considered to be arranging transactions in investments or otherwise
engaging in investment business.

23. GENERAL
- 23.1 If any provision of
these Terms and Conditions is held to be invalid, void or unenforceable
by reason of any law, rule, administrative order or judicial decision, that determination
shall not affect the validity of the remaining provisions of these Terms and Conditions
.
- 23.2 The headings in these
Terms and Conditions are for convenience of reference only and do
not affect the construction or interpretation of any provision.
- 23.3 Notices and other communications
delivered or mailed to the postal address or to the electronic-mail address provided
by the Customer shall, until BETDAQ has received notice in writing of any different
address, be deemed to have been personally delivered once sent whether actually
received or not.
- 23.4 Each Customer hereby agrees
that these Terms and Conditions shall be binding upon his/her heirs,
executors, administrators, personal representatives and permitted assigns. These
Terms and Conditions shall inure to the benefit of BETDAQ and its
successors, assigns and agents. We may assign our rights and duties under these
Terms and Conditions to any of our subsidiaries or affiliates without
giving notice, or to any other entity upon prior written notice. You may not assign
your rights without our prior written consent.
- 23.5 The relationship of
BETDAQ and the Customer established by these Terms and Conditions is
that of independent contractors, and nothing contained in these Terms and Conditions
shall be construed to:
- 23.5.1 give either party
the power to direct and control the day-to-day activities of the other;
- 23.5.2 deem the parties
to be acting as partners, joint venturers, co-owners or otherwise as participants
in a joint undertaking; or
- 23.5.3 other than as stated
in these Terms and Conditions, permit either party or any of either
party's officers, directors, employees, agents or representatives to create or assume
any obligation on behalf of the other party for any purpose whatsoever.
- 23.6 Any waiver by BETDAQ
of any breach of, or default under, these Terms and Conditions by
a Customer shall not be considered as a waiver of any subsequent breach.
- 23.7 Failure or delay by
BETDAQ in enforcing or partially enforcing any condition of these Terms and Conditions
shall not be interpreted as a waiver of any of BETDAQ rights under
these Terms and Conditions.
- 23.8 These Terms and Conditions
supersedes all prior agreements between the parties in relation to
its subject matter and represents that entire agreement between BETDAQ and the Customer.
Nothing in these Terms and Conditions shall operate or be interpreted
to limit or exclude either party's liability or remedies for any fraudulent misrepresentation.
- 23.9 These Terms and Conditions
shall be subject to and interpreted in accordance with Gibraltar Law
and shall be subject to the non-exclusive jurisdiction of the courts of Gibraltar.
- 23.10 These Terms and Conditions
have been prepared in various languages other than English for reference
only. In the event of any differences between the English version of these Terms
and Conditions and any non-English versions, the English version shall
prevail.

PART 3 THE BETDAQ RULES
-
1. GENERAL RULES
- 1.1 Abandoned/Postponed
events
- 1.1.1 If any single event
(match, game, race etc.) is not completed within 72 hours of the original, scheduled
completion date then all bets on the event will be void, except those on markets
which have been unconditionally determined.
- 1.1.2 If any tournament
or competition is not completed within seven days of the original, scheduled completion
date then all relevant markets will be settled based on the official result of the
relevant governing body, provided the result is announced within 30 days of the
original scheduled completion date.
- 1.1.3 Where a number of
days are specified in relation to the completion of an event, the specific cut-off
time would be 23:59:59 in the time zone where the event was scheduled to take place.
- 1.2 Venue changes
and Event durations
- 1.2.1 If there is a change
to the scheduled venue for an event then all bets will stand unless the new venue
is the home ground of the team originally listed as the away team.
- 1.2.2 If there is a change
in the type of surface an event was due to take place on (e.g. a tennis match changing
from grass to hard court) then all bets will be void.
- 1.2.3 Unless specifically
stated otherwise, all bets apply to the regular time period of an event, including
any stoppage or injury time played. Extra-time periods or other methods for deciding
a contest will not count for the purposes of settlement.
- 1.2.4 If the scheduled duration
of an event is changed before the event starts then all bets on the event will
be void.
- 1.3 Dead Heats Rules
If two or more selections finish in a dead heat in a market, the return for a winning
back bet would be reduced. The reduction is calculated by multiplying the original
Stake by the number of expected winners and dividing it by the number of dead-heated
selections. The total return is then calculated based on the reduced Stake (i.e. the
reduced Stake at the original odds) with the net winnings being this amount less
the original Stake.
Example 1: In a market where three selections dead heat for 1st
place, a back bet on one of the winners on €60 at 6.0 or 5/1 is settled
as follows: The Stake of €60 is multiplied by the number of expected winners
(1) and divided by the number of dead heated selections (3) to calculate the reduced
Stake (€60 x 1/3 = €20). The return is then the reduced Stake at the
original odds (€20 x 6 = €120). The net winnings are €60 or the
return (€120) less the original stake (€60).
Example 2: Take a market with three expected winning selections
(e.g. Horse racing place market), where one selection is an outright winner and four
selections dead-heat for second place. Once the outright winner has been settled,
there are two remaining 'places' in the market. A bet of €60 at 6.0 or 5/1
on one of the four dead-heated selections is settled as follows, the Stake of €60
is multiplied by the expected number of winners (2) and divided by the number of
dead heated selections (4) to calculate the reduced Stake (€60 x 2/4 = €30).
The return is then the reduced Stake at the original odds (€30 x 6 = €180).
The net winnings are €120, or the return (€180) less the original Stake
(€60)
- 1.4 In running markets
- 1.4.1 We reserve the right
to suspend an in running market at any time or decide against turning a market In
Running if there are problems with the feeds used to manage an event, or other technical
difficulties. In these circumstances we accept no liability for Customers' inability
to make offers.
- 1.4.2 Customers should be
aware that broadcasts described as "live" may actually be subject to delays and
that the extent of the delays may vary depending on the broadcaster.
- 1.4.3 There is a built in
delay when placing bets in an in running market. The length of the delay will
depend on the sport and on broadcasts available for the event.
- 1.4.4 A bet placed at
a price that will match, when the Customer confirms the bet, is subject to the In
Running delay. A bet placed at an unmatched price, when the Customer confirms the
bet, is not subject to the in running delay and will be placed immediately as
an unmatched offer in the market. Customers should be aware that bets that are subject
to an in running delay cannot be cancelled until the time delay has expired.
- 1.4.5 When managing unmatched
offers in an in running market, a change of Stake will not be subject to an in running
delay. A change of odds to a price that will get matched in the market will be subject
to a delay, and a change of odds to a price that will not get matched is not subject
to the in running delay.
- 1.5 Unmanaged in running
markets
- 1.5.1 Unmanaged in running
markets are markets which are turned in running at the scheduled start of a game
and are available for betting during the game but are not managed at any stage
during the game ie the market will not be suspended if a goal is scored, a penalty
is awarded or a player is sent off.
- 1.5.2 An unmanaged in running
market will be turned in running at the scheduled start of the match with unmatched
bets, except for those specifically selected to go in running, cancelled. Once
in running, unmatched bets will not be cancelled at any stage.
- 1.6 'Keep In-Running'
bets
- 1.6.1 For any market that
is due to turn in running, a Customer can select the option for their unmatched orders
to remain 'open' in the market when it is turned in running. This option is available
when a bet is being placed, or alternatively by selecting the option and updating
the bet in the "Current Bets" panel. Once selected, the unmatched bet will not
be cancelled when the market turns in running, or when the market is reset following
a goal, penalty or sending off in a soccer match.
- 1.6.2 Other than as set
out below, unmatched "lay" offers to be cancelled when a non-runner is removed from
a horse racing market, provided the deduction factor of the non-runner or the accumulated
deduction factors for the market is 2.5% or greater in "Win" markets and 4.0% or
greater in "Place" markets. However, bets placed with the "Keep In-Running" option
will not be cancelled; back betss will remain on the site without being re-priced
and the lay odds will be re-priced taking into account the deduction factor of the
non-runner. This feature will override any personal settings selected in the Preference
section.
- 1.6.3 Generally, there is
no point, other than when the market is finally closed, where "Keep in running"
betss will be cancelled; however, we reserve the right to cancel "Keep in running"
bets if it is deemed necessary to protect Customers.
- 1.7 Market management
- 1.7.1 If a market is due
to close at the start of an event, but fails to close for any reason, we reserve
the right to void all bets placed after the start of the event. In the absence
of an official 'off' time for the event, or a source for the 'actual' start time,
the scheduled start time will be used.
- 1.7.2 1.7.2 If a market is due to go in running at the start of an event, but is not turned in running and unmatched bets are not cancelled, we reserve the right to void all bets matched after the start of the event. We endeavour to turn markets in running at the start of the game, match or event (as applicable) but cannot guarantee that markets will be suspended or turned in running at the time stated within the Market Info Tab (as defined below). If a market set to be turned in running does not do so at the stated time but is later turned in running within the duration of the game, match or event (as applicable) all bets matched prior to a “significant event” (for example, a goal scored in football, a try scored in rugby, a touchdown scored in American football, as determined by Betdaq in its sole discretion) will stand. If a “significant event” has occurred without the game being turned in running, bets matched between the “significant event” in question and the market turned in running will be void. If a market set to be turned in running at the event start time fails to do so or is not suspended at any stage for the duration of the game, match or event (as applicable) all bets matched after the official event start time will be void.
- 1.7.3 If the situation outlined
in paragraph 1.7.2 occurs:
- 1.7.3.1 and the market
is not turned in running at any stage during the event, bets placed after the
start of the event will be void. In the absence of an official "off" time for the
event, or a source for the actual start time, the scheduled start time will be used.
- 1.7.3.2 in markets other
than soccer, and the market is turned in running during the event, bets placed
between the start of the event and the market being turned in running, will be void.
In the absence of an official "off" time for the event, or a source for the actual
start time, the scheduled start time will be used.
- 1.8 Market settlement:
- 1.8.1 All markets will be
settled in accordance with the Betdaq Rules and the market ("Info"),
as set out and displayed in the Info tab beside all markets(the “Market Info Tab”). In the case of any
ambiguity, the rules as described in the Relevent Market Info Tab will be final for the purposes
of settlement. We reserve the right to reverse the settlement of a market if there
has been an error in the original settlement, and to make the necessary amendments
to Customer's Accounts to reflect any changes in the settlement of the market.
- 1.8.2 In the event of any
doubt surrounding the result of a market or event, we reserve the right to withhold
settlement of the market until such time as said doubt has been removed. In the
event that the result cannot be verified, we reserve the right to void the market.
- 1.8.3 Markets will generally
be settled as soon as the result can be confirmed. As a courtesy to Customers, we
may decide to settle or part settle some markets or selections before an official
result has been announced; however, we reserve the right to amend this settlement
if the official result is different to that used for the original settlement, or
if the whole market is eventually to be voided.
- 1.8.4 Unless otherwise stated,
all markets will be settled based on the official result, regardless of subsequent
amendments to the result.
- 1.9 Miscellaneous
- 1.9.1 While every effort
is made to ensure complete accuracy, we cannot accept liability for any errors or
omissions relating to information displayed on the site. We reserve the right to
make changes to correct any obvious errors.
- 1.9.2 It is the responsibility
of each Customer to ensure he/she is aware of the rules governing individual markets.
We cannot accept any responsibility for any errors in respect of the posting of
offers by Customers.
- 1.9.3 Allowing for minor
spelling mistakes, if an incorrect selection (team, player or otherwise) is displayed
in a market, or the incorrect number of selections or outcomes are available in
a market, or a market includes any obvious error, we reserve the right to void bets
in the market or the market as a whole.
- 1.9.4 In order to protect
the integrity of markets on the site and to protect Customers of the site, we reserve
the right to cancel unmatched bets at any time, to suspend betting on any market
at any stage, and ultimately, if deemed necessary, to void certain bets or a market
as a whole.
- 1.9.5 We reserve the right
to suspend any market, at any time, at our discretion, in order to amongst other
reasons, protect Customers for any reason and to carry out market administration.

runners, times, place terms, scores, results, venues.
- 1.9.7 The General rules
in Section 1 shall apply in situations where the specific rules for a sport (as
outlined in sections 2 to 29 below) or the Info set out in the relevant Market Info Tab do not deal specifically
with a particular scenario.
- 1.9.8 We reserve the right
to amend any of the rules at any time. Any amendment to a rule is effective immediately
once displayed on the Betdaq Website.

2. AMERICAN FOOTBALL
- 2.1 All bets will be settled
on the official result including any overtime played unless otherwise stated in
the Market Info Tab (e.g. the half time/full time market or where the market has been unconditionally determined. In the event of a tie after overtime all bets placed on "Money
Line" markets will be void. Subsequent amendments to the official result at the
end of the game will have no bearing on market settlement.
- 2.2 If a match does not start
on the scheduled start date or is not played to completion, at the same venue, within
72 hours of the original start time, then all bets will be void except for those on markets which have been unconditionally determined.
- 2.3 If a match has started
and is later abandoned or postponed and not resumed within 72 hours then all bets,
except for those unconditionally determined, will be void unless (i) 55 minutes have elapsed
or (ii) an official result has been called in which case the match will be accordingly
determined.
- 2.4 For "Handicap" and "Total"
markets, if the final result falls on the number listed for the market, then the
bet shall be deemed a 'push' and the client has the Stake returned.
- 2.5 For individual match-up
and 'prop' markets, players must play for bets to stand.

3. ATHLETICS
- 3.1 Unless stated otherwise in the Market Info Tab, bets on abandoned, postponed
or cancelled events will be void except for those on markets which have been unconditionally determined unless the event is held at the original venue
within seven days of the original date.
- 3.2 All markets will be settled
based on the official result at the time of the medals presentation, regardless
of subsequent amendments to the result. In the absence of a medals presentation,
bets will be settled in accordance with the first, official result announced and
regardless of subsequent amendments to the result.

4. AUSTRALIAN RULES
- 4.1 All bets, except for markets in "Finals" matches, apply to regular time only and exclude any overtime played. Bets on "Finals" matches will be settled on the official score including any overtime played, except for those on markets which have been unconditionally determined or as stated otherwise in the Market Info Tab (e.g. half-time/full-time markets). If the game results in a tie, Dead Heat Rules apply to bets on the match odds market unless otherwise stated in the Market Info Tab.
- 4.2 bets on postponed matches
will be void unless the match is played within 72 hours of the original scheduled
start time.
- 4.3 If a match starts but
is subsequently abandoned/postponed and not completed within 72 hours of the original
scheduled start time then the following applies to bets on match odds markets:
- 4.3.1 If the first half
has not been completed the match will be settled as a tie and Dead Heat Rules will
apply.
- 4.3.2 If the first half
has been completed then the match will be settled on the official result notified by the
relevant governing body.
- 4.4 4.5 All bets relating to individual player’s will stand if they are listed as part of the 22 player squad on the match day, irrespective of whether they take any part in the match or not.
- 4.5 All other bets on abandoned
or postponed matches will be void except for those on markets that have unconditionally
been determined.
5. BANDY
- 5.1 All bets will be settled
on the basis 90 minutes play unless otherwise stated in the market Info. If 90 minutes play
is not completed for any reason, all bets will be void unless an official result
is declared. If a match is played in 3x30 minute periods instead of 2x45 minute
periods bets will stand.
- 5.2 If a match is abandoned
or postponed, all bets, except for those unconditionally determined, are void unless the
match is completed within 36 hours of the original scheduled start date, or an official
result is declared.
6. BASEBALL
- 6.1 If a game does not start
on the scheduled date then all bets on that game will be void except for those
unconditionally determined. Markets are settled on the final score including any extra innings
played, unless otherwise stated in the market Info Tab.
- 6.2 "Listed Pitcher" markets
will be void if either starting pitcher is different to the pitcher named in the market.
- 6.3 For "Money Line" markets,
5 full innings (or 4.5 if the home team is ahead) are required to constitute a completed
game. If a game is called or suspended, the winner is determined by the score after
the last full innings unless the home team scores to tie, or takes the lead in the
bottom half of the innings, in which case the winner is determined by the score at
the time the game is called. bets will be void if the home team ties the game
and it is then suspended.
- 6.4 For "Run Line" and "Totals"
markets, 9 full innings (or 8.5 if the home team is ahead) are required to constitute
a completed game. If a game is called or suspended in extra innings, the score will
be determined after the last full inning unless the home team scores to tie, or
takes the lead in the bottom half of the inning, in which case the score is determined
at the time the game is called.
- 6.5 6.5 These Betdaq baseball rules apply to Major League Baseball (MLB), World Baseball Classic and Japanese Baseball. All other baseball will be governed by rules set out in the General Rules and the relevant Market Info Tab.
7. BASKETBALL
- 7.1 bets will be settled
on the official score including any overtime played, unless otherwise stated in
the market Info.
- 7.2 7.2 If a match is abandoned or postponed before 43 minutes have been played in an NBA match, or 35 minutes in any other match, and no official result has been declared then all bets will be void, except for those on markets which have been unconditionally determined. In these circumstances, if the scores are tied then Dead Heat Rules will apply to bets on the outright match winner market.
- 7.3 7.3 If a match does not start on the scheduled start date then all bets will be void.
8. BOXING
- 8.1 8.1 If a fight is abandoned or postponed, all bets, except for those unconditionally determined, are void unless the fight is completed within 72 hours of the original scheduled start time, or an official result is declared. If the fight is relocated to another country after the market has been opened or a boxer withdraws or is substituted before the fight starts, all bets will be void. If the number of scheduled rounds or the duration of individual rounds is changed, then all bets will be void.
- 8.2 All bets will be settled
on the official result announced following the fight, regardless of any subsequent
amendments to the result.
- 8.3 If for any reason a points
decision is awarded before the full number of rounds is completed or a boxer is
disqualified, bets will be settled on the round in which the fight was stopped.
If a boxer retires between rounds, fails to answer the bell, or is disqualified
between rounds, bets will be settled based on the fight being finished at the
end of the previous round.
9. CHESS
- 9.1 Joint winners of chess
tournaments will be settled under Dead Heat Rules. Tiebreak rules will not be applied.
- 9.2 In knockout events the
eventual winner, by whatever means, will be deemed to have won the event. bets
are valid when each player has made at least one move; otherwise, bets are void
and Stakes refunded.
10. CRICKET
- 10.1 General
- 10.1.1
Matches will be turned in running at the scheduled start time.
Matches that are not going in running will be closed at the scheduled start time.
- 10.1.2 If a match is shortened
due to the weather, markets, including those decided by the Duckworth Lewis method,
will be settled based on the official result. If a match starts, but is not completed
for any reason other than weather and no official result is declared then Betdaq reserve
the right to void all bets on markets which have not been determined.
- 10.1.3 10.1.3 If a ball is not bowled during a competition, series or match then all bets will be void except for those on any market that has been unconditionally determined.
- 10.1.4 All bets on match
betting markets will be void if the official result is a tied match in any Test,
County or Limited Over match.
- 10.1.5 If a "Limited Over"
match finishes in a tie then that is the result that will count for the purposes
of settlement, regardless of any "Bowl Outs", "Super Overs" or otherwise that may
be played.
- 10.2.1
10.2.1 If fewer than 20 overs are bowled in an innings then bets on innings runs markets will be void unless the market has been unconditionally determined. In the event of a match being decided by a “Bowl Outs” or coin toss then all bets will be void, unless market Info states otherwise.
- 10.2.2 10.2.2 If a match starts but is later abandoned for any reason other than weather (examples of which would be dangerous or unplayable wicket or outfield; strike or boycott; crowd protests/violence; pitch vandalism; stadium damage; acts of terrorism; and acts of God), Betdaq reserves the right to void all bets, except for those on markets that have been unconditionally determined.
- 10.2.3 10.1.3 10.2.3 If the match is not scheduled to be completed within five days after the original scheduled completion date, then all bets on markets for this event will be void, except for bets on any markets that have been unconditionally determined.

- 10.3.1 Limited Over
matches
If "No Result" is declared for a match then all bets will be void except for those
on markets unconditionally determined as specified in the market Info.
- 10.3.2 Limited Over
matches
Where the Duckworth Lewis method is used all matched bets on 'Highest 10 over Total' and 'Opening Partnership' will be void, unless the market has been unconditionally determined before the Duckworth Lewis rule was implemented. All other markets will be settled according to the result determined under the Duckworth Lewis method.
- 10.4.1 Batsmen markets
If any player named in any "Top Team Batsman" market is not chosen in the starting
XI, all bets in that market will be void. If any player chosen in the starting
eleven does not bat, he will be deemed to have scored zero. If any player retires
and does not resume his innings his score will stand.
- 10.4.2 Batsmen markets
If any player retires and does not resume his innings his score will stand
11. CYCLING
- 11.1 bets on abandoned,
postponed or cancelled events will be void unless the event is held at the original
venue within seven days of the original date.
- 11.2 All markets will be
settled based on the official result at the time of the medals presentation, regardless
of subsequent amendments to the result. In the absence of a medals presentation,
bets will be settled in accordance with the first, official result announced and
regardless of subsequent amendments to the result.
12. DARTS
- 12.1 Should a player fail
to compete in an individual match or an event, all bets involving that player
will be void. In the event of a match starting but not being completed, the player
progressing to the next round will be deemed the winner.
- 12.2 If a match is not completed,
all bets on set betting, total games, correct score, next leg winner and handicap
will be void except for those unconditionally determined or unless otherwise stated in the
market Info.
- 12.3 If a match is not completed then bets on handicap markets will be void unless the market has been unconditionally determined.
13. FINANCIAL MARKETS
- 13.1 Intraday Markets
Customers are betting on the price quoted in the market. Each market will be settled
on the first Bloomberg price stamp past the quoted market closure time.
- 13.2 Daily and Weekly
Markets
Customers are betting on the price quoted in the market. All Daily and Weekly markets
will be settled on the official close prices given by Bloomberg. All Midday and
PM markets will be settled on the first Bloomberg price stamp past the quoted market
closure time.
14. GAA (BOTH FOOTBALL AND
HURLING))
Unless otherwise stated, all GAA match bets apply to the full match duration,
including injury time but not extra time. If a match is abandoned or postponed,
all bets, except for those unconditionally determined, are void unless the match is completed
within 72 hours of the original scheduled start date, or an official result is declared.
15. GOLF
- 15.1 General
- 15.1.1 All bets will
be settled on the official result after the tournament regardless of subsequent
amendments to the result.
- 15.1.2 If a tournament
is shortened for any reason, all bets will be settled based on the official result,
provided the minimum number of holes set out in the market Info has been completed.
In this instance, bets matched after the last completed round will be void.
- 15.1.3 Once a player has
teed off all bets on that player will stand, regardless of subsequent withdrawals/disqualifications.
If a player does not start the tournament then all bets on that player will be
void.
- 15.1.4 16.1.4 In 'to qualify' markets for any tournament the winners are the number of golfers that qualify for the tournament under the terms set out in the Market Info Tab, whether they compete in the tournament or not. Markets will be settled after the qualifying stage and any subsequent disqualification or amendment to results will not count.
- 15.2 Tournament Match
Markets
- 15.2.1 If a player withdraws
before starting their first round all bets on the relevant market will be void.
If all players in a market fail to complete the first round all bets will be void.
- 15.2.2 Any player who misses
the cut is deemed to be a loser against any player that makes the cut, regardless of subsequent
withdrawals/disqualifications.
- 15.2.3 If a player withdraws
or is disqualified during a round they will be deemed to be a loser against any player
that completes that round.
- 15.2.4 If all players fail
to complete a particular round for any reason the winner is the player with the
lowest total score after the previous round.
- 15.3 18 Hole Three
Ball/Two Ball Markets
If any player fails to start the round then all bets on the market will be void.
Any player that fails to complete the round, having teed off, is deemed a loser
against a player that finishes the round. If all players fail to complete the round
for whatever reason then all bets will be void.
- 15.4 Place Betting/Each-Way
Betting
These markets will be settled according to the number of places in the market Info Tab.
Dead Heat Rules shall apply except where a winner is determined by a play-off.
- 15.5 Matchplay/Strokeplay
individual hole markets
- 15.5.1 Markets will be
settled once the hole has finished regardless of subsequent amendments to
the result.
- 15.5.2 If a hole is not
completed for any reason other than a player or pairing conceding a hole, then all
bets on that market will be void. If a player or pairing does not start a hole
then all bets on that market will be void. If a player or pairing withdraws or
is disqualified having started a hole they are deemed a loser against a player that
finished the hole.
16. GREYHOUND RACING
- 16.1 General
Markets will be settled on the basis of the first official result from the track, regardless
of subsequent amendments to the result. All bets are placed on trap numbers. Greyhound names are displayed for information purposes only. If a non-runner or reserve runner is declared,
all bets will be void and a new market will be opened. If no runners finish a
race or a race is declared void then all bets will be void. If the venue is changed
after a market has been opened all bets will be void. In ante-post markets, all
bets on individual greyhounds stand whether the greyhound runs or not. All ante-post
bets will be void if the competition is abandoned or the venue is changed. The number of winners in 'to be placed' markets is as set out in the Market Info Tab and is determined with reference to the number of runners known when the market is loaded. Once opened, the number of winners in 'to be placed' markets (as set out in the Market Info Tab) will not be affected by further non-runners. If the number of potential winners in a ‘to be placed’ market is equal to or is greater than the number of runners, all bets in this market will be void
- 16.2 Ante Post
- 16.1.1 If Betdaq becomes
aware that a greyhound listed in an ante-post market has died, the market will be
suspended while we determine the accuracy of the information and the time of the
greyhound's death. Once this has been confirmed, the selection will be removed from
the market and, if appropriate, void all bets placed on the market from midnight
on the date of death.
- 16.1.2 If a race is postponed
or rescheduled, but run at the same venue on another day, all ante-post bets will
stand provided the entries are not re-opened.
- 16.1.3 Bets matched on greyhounds after they have forfeited their entry at a particular entry stage or where they have not qualified by the applicable qualifying date will be voided unless the race in question has a subsequent supplementary entry stage.
17. HANDBALL
Unless otherwise stated in the Market Info Tab, all bets apply to the full match duration
excluding extra time. If a match is abandoned or postponed, all bets, except for
those unconditionally determined, are void unless the match is completed within 36 hours
of the original scheduled start date, or an official result is declared.
18. HORSE RACING
- 18.1 General
- 18.1.1 All individual race
markets are decided on the official result at the time of the 'weigh-in', regardless
of subsequent amendments to the result. If a race is abandoned, or declared void,
all bets on the race will be void. In the event of a walkover, all bets on that race will be void If a race is postponed and not run on its scheduled
day, all bets will be void. If the venue or the surface (e.g. turf/dirt) for a race
is changed after the market has been activated all bets will be void.
- 18.1.2 In the event of
a false start or similar incident resulting in a race being re-run, 'under starter's
orders' is negated and horses taking no part in the re-run will be treated as non-runners.
- 18.2 Ante-post
- 18.2.1 Ante post betting
is deemed to finish at the final declaration stage. All bets on individual horses
will stand whether the horse runs or not, unless the horse is balloted out.
- 18.2.2 bets placed on
horses after they have forfeited their entry at an entry stage or where they have
not qualified by the qualifying date will be void unless that race has a later supplementary
entry stage. No Betdaq non-runner rule deductions are made to ante-post bets.
- 18.2.3 If a race is officially
abandoned, declared void or the Conditionsof the race are altered all bets will
be void. If a race is postponed, but run at the same venue within seven days of
the original scheduled date, all bets will stand provided the Conditionsof the
race remain the same and the entries are not re-opened.
- 18.2.4 If Betdaq becomes
aware that a horse listed in an ante-post market has died, all markets where the
horse is a selection will be suspended while we determine the accuracy of the information
and the time of the horse's death. Once this has been confirmed, the selection will
be removed from the market and, if appropriate, void all bets placed on the market
from midnight on the date of death. If an accurate time for the horse's death can
be ascertained, Betdaq may, using its discretion and all the information available,
decide to void bets from a more reasonable time.
- 18.3 Place Markets
The possible number of 'placed' or winning selections in a market is stated above
the individual market and is determined by the number of declared runners when the
market is being setup. Once the market has been displayed, further non-runners will
not affect the number of 'places' in a market. If the number of potential winners,
as stated above the market, is equal to or greater than the number of runners, all
bets on this market will be void. If the number of 'Placed' horses in a race is
less than the number of potential winners listed, the winning selections will only
be the placed horse or horses.
- 18.4 Each Way Markets
The place element of your "Each Way" bet will be settled according to the number
of 'places' stated above the market. The number of 'places' in an "Each Way" market
is based on the number of selections that participate in a race and can be affected
by non-runners. In the event of there being less than five runners in the race all
bets will be void.
- 18.5 Other Horse
Racing Rules
- 18.5.1 Card numbers are
included as a guide only; bets are placed on the named horse.
- 18.5.2 Horses are not coupled
for betting purposes. If a horse is running for purse money only, or the stewards
declare it will not be included for betting purposes, it will be deemed a non-runner.
If this results in the number of potential winners, stated above the market, being
equal to or greater than the number of runners in the market, all bets will be
void.
- 18.6 Winning Distance
Markets
- 18.6.1 Unless otherwise
stated in the market Info, bets on 'winning distance' markets are on the sum of
the winning distances from each race on one particular day at a race meeting.
- 18.6.2 The winning distance
in a race will be the officially declared distance between the first and second
placed horses.
- 18.6.3 For the purpose
of these markets the maximum distance on any individual race will be 12 lengths
for Flat races and 30 lengths for National Hunt races (including National Hunt Flat
Races) and these distances will be applied if only one horse finishes a race. For
distances below half a length the following scale will be applied:
Nose 0.05 length
Short-head 0.1 length
Head 0.2 length
Short-neck 0.25 length
Neck 0.3 length
- 18.6.4 If there are three
or more races abandoned or declared void at a meeting, then all bets on winning
distance markets will be void. If there are only one or two races abandoned or declared
void then a default distance will be used for each abandoned or void race. The distances
used will be 2 lengths for Flat races and 10 lengths for National Hunt races.
- 18.6.5 In the case of a
walkover or no horse finishing the race the distances that will be applied are five
lengths for Flat races and 12 lengths for National Hunt races.
- 18.7 Non-Runner Rules
- 18.7.1 18.7.1 Any horse
in the Betdaq market that does not come under starter's orders is deemed to be a
non-runner.
- 18.7.2 18.7.2 In the event
of a false start or similar incident resulting in a race being re-run, the rule
regarding 'under starter’s orders', as set out in paragraph 18.7, will not apply
and horses taking no part in the re-run will be treated as non-runners.
- 18.7.3 18.7.3 All horse
racing markets displayed are subject to Betdaq's non-runner rule, which relates
to the adjustment of odds on bets unconditionally placed when a horse in a race is declared
a non-runner. The adjustment is made by applying a 'deduction factor' (on the basis set out in paragraph 18.9) to the remaining
horses. The deduction factor for each horse is broadly based on that horse's chances of
being a winner in the market.
- 18.7.4 18.7.4 When the
market is opened, all runners will be allotted a deduction factor that is based
on a forecast price. These deduction factors may be updated during the day based
on trading in the market. The deduction factor for each horse can be found by clicking
on the name of the horse.
- 18.8 Non-Runner Withdrawals
- 18.8.1 As soon as Betdaq
has confirmed that a horse is a non-runner in a race, that horse will be removed
from the market and all bets on that horse will be void.
- 18.8.2 In the "Win" and
"Each Way" markets, if the deduction factor of the non-runner is 2.5% or greater,
the odds of all bets placed on the remaining horses will be reduced by an amount
equal to the non-runners final deduction factor. The unmatched offers to lay the
remaining horses will also be cancelled (unless otherwise set out under "Preferences"
in the "My Account" section). If the deduction factor of the non-runner is less
than 2.5% no deductions will be made and no unmatched bets will be cancelled.
- 18.8.3 In the "Place" market,
if the deduction factor of the non-runner is 4.0% or greater, the potential winnings
from all bets placed will be reduced by an amount equal to the non-runners final
deduction factor . If the deduction factor of the non-runner is less than 4.0% no
unmatched bets will be cancelled.
- 18.8.4 After the withdrawal
of any non-runner, the deduction factors on the remaining horses will be adjusted
to reflect their improved chance of winning.
- 18.8.5 In the event of
a late withdrawal, Betdaq reserves the right to withdraw the horse and apply the
deduction factor after the race. If a race is unconditionally in running, Betdaq reserves
the right to suspend the market until such time as the non-runner can be removed.
- 18.8.6 If a non-runner
is removed from a race in error, the runner will be re-instated and all bets in
relation to that runner will stand (accounts may have to be adjusted manually to
reflect the original bets). All bets made between the time of the withdrawal
and the re-instatement will be void in all related markets. The deduction factor
applied to bets at the time of the withdrawal will be reversed and the original
prices will become valid.
- 18.9 Deduction Factors
- 18.9.1 In "Win"
and "Each Way" markets the deduction factor is applied to the price of each bet.
- 18.9.2 For example:
if a horse with a final deduction factor of 15% is withdrawn, the odds of all bets
placed on the remaining horses will be reduced by 15%, e.g. a bet placed at odds
of 6.0 would become 5.10 after the deduction had been applied (6.0 x 0.85 = 5.10).
- 18.9.3 These odds
may be reduced further if there are additional horses declared as non-runners and
withdrawn from the market. If a non-runner in an Each Way market, results in the
number of 'places' in the market being reduced, the revised place terms will be
applied to all bets in the market.
- 18.9.4 In "Place"
markets the deduction factor is applied to the potential winnings on each bet
only, and not the odds of the bet.
- 18.9.5 For example:
if a horse with a final deduction factor of 15% is withdrawn, the potential winnings
on all previously matched bets on the remaining horses will be reduced by 15%,
ie a bet placed at odds of 6.0 would become 5.25 after the deduction had been
applied.
- 18.9.6 For instance, a
€20 bet at odds of 6.0, where the potential winnings would be €100.
If a non-runner were withdrawn with a deduction factor of 15%, the deduction would
be applied to the potential winnings of €100, leaving potential winnings of
€85 or a revised matched price of 5.25.
- 18.9.7 These odds
may be reduced further if there are additional horses declared as non-runners and
withdrawn from the market.
- 18.10 Points to
note:
- 18.10.1 If two or more
horses are withdrawn from a "Win" or "Each Way" market, each of which has an individual
deduction factor of less than 2.5%, but the combined deduction factor is more than
2.5%, then the combined deduction factor will be applied as per the example above.
This is also the case for "Place" markets where the combined deduction factor is
more than 4.0%.
- 18.10.2 A reserve runner
may appear in a market but it will not have an applicable deduction factor until
such time as the horse has been confirmed as a runner. A non-runner that is replaced
by a reserve will be treated in the same manner as a regular non-runner and as such
the relevant deduction factor will be applied.
19. ICE HOCKEY
- 19.1 Unless otherwise specified,
all bets will be settled on the official, final score at the end of regular time,
including any overtime and shoot-outs that get played.
- 19.2 19.2 If a match starts but is later postponed or abandoned and less than 55 minutes are completed, and no official result is announced, then all bets will be void, except for those on markets which have been unconditionally determined. Matches that do not start on the scheduled date will be void.
20. GAA (INTERNATIONAL / COMPROMISE
RULES)
bets will be settled on the official result. betson abandoned or postponed matches
are void unless the match is played at the original venue within 36 hours of the
original scheduled start time.
21. MOTOR SPORT
- 21.1 Outright championship
markets will be settled according to the official rules of the relevant governing
body. Should a listed selection fail to compete in the relevant Championship then all bets
on that selection will be void.
- 21.2 The warm-up lap will
count as the start of a race. Race markets will be settled on the official result
of the relevant governing body, regardless of any subsequent disqualifications or
amendments to the result. If a race is abandoned and no podium ceremony takes place
or no official result is declared then all bets on that race will be void except
for bets on markets that have unconditionally been determined.
- 21.3 If the scheduled venue is changed after the market has been offered by Betdaq, all bets will be void.
- 21.4 In match markets, the competitor who has finished ahead or completed the most number of laps will be settled as the winner.
- 21.5 21.5 In Speedway, bets will be void if all scheduled heats or races of a meeting or match are not completed except on markets which have been unconditionally determined.
22. POKER
- 22.1 All bets will be settled
on the official result as declared immediately after the event. If a player does not take part,
all bets on that player are void. A player must be dealt at least one hand in
order to qualify as a participant.
- 22.2 If a tournament is abandoned
and no official result is declared, all bets will be void.
23. ROWING
- 23.1 If a crew or individual
fails to start a competition or race, all bets on that crew or individual will
be void. If a crew or individual starts, but does not complete a race they will
be settled as a loser provided somebody completes the race. If nobody completes
the race then all bets will be void.
- 23.2 If an event is postponed,
abandoned or interrupted, all bets, except for those unconditionally determined, will
be void unless the event is completed within seven days or the governing body announces
an official result.
- 23.3 All markets will be
settled based on the official result at the time of the medals presentation, regardless
of subsequent amendments to the result. In the absence of a medals presentation,
bets will be settled in accordance with the first, official result announced and
regardless of subsequent amendments to the result.
24. RUGBY UNION AND RUGBY LEAGUE
- 24.1 All rugby match bets
apply to regular time, including injury time but not extra time, unless otherwise
stated in the market Info.
- 24.2 If a match is abandoned
or postponed, all bets, except for those unconditionally determined, are void unless the
match is completed within 36 hours of the original scheduled start date, or an official
result is declared. If there is a change of venue all bets will stand as long
as the match is played within 36 hours of the original scheduled start time and
the match is not played at the ground of the team originally listed as the away
team.
- 24.3 'Tournament tries' and 'tournament point' bets will apply to all playing time, including any extra-time played in all matches where an official result is announced.
- 24.4 For 'time of first try' bets, if the try is scored in the second half, the first half is deemed to have lasted 40 minutes, regardless of stoppage-time. If no try is scored, or the try is scored in second half stoppage-time or extra-time, the result is 80.
- 24.5 For the purpose of markets involving tries, penalty tries will count with the exception of 'first individual try scorer' markets where penalty tries will not count.
25. SNOOKER / POOL
- 25.1 Should a player fail
to compete in an individual match or an event, all bets involving that player
will be void. In the event of a match starting but not being completed, the player
progressing to the next round will be deemed the winner.
- 25.2 In the case of a match
that is not completed, all bets on 'Handicap', 'Correct Score' or similar markets
will be void.
26. SOCCER
- 26.1 General
- 26.1.1 Unless otherwise
stated, all football match bets apply to regular time only. This includes injury
time but not any extra time periods or penalty shoot-outs. All bets will be void
on matches where there is a change of opponent. If there is a change of venue all
bets will stand unless the match is played at the ground of the team originally
listed as away.
- 26.1.2 If a match is postponed
or delayed and does not (or will not) start by midnight on the scheduled date then
all bets on the match will be void unless we are aware that the match has been
rescheduled to be played within 36 hours of the original scheduled date.
- 26.1.3 If a match is abandoned
or postponed after it has kicked-off then all bets on all markets associated with
this match will be declared void unless the match is completed (according to the
official source) within 36 hours of the original scheduled time, except for any
instance where an unconditional definitive result for a market has unconditionally been
determined prior to abandonment: for example first goal scorer, time of first goal
or half time result. In the event of an abandoned match restarting from the beginning
(within the 36 hours) bets matched prior to kick-off of the original match and
bets on markets which have been unconditionally determined will stand. All other
bets will be declared void.
- 26.1.4 If a team is thrown
out or disqualified from a league before the season starts then all bets on affected
markets will be void. If the league has unconditionally started, (i.e. the first league game
has been played) all bets will stand and the team will be settled as a loser.
- 26.1.5 For "First Goalscorer"
or "Last Goalscorer" markets, bets will be voided on any player who takes no part
in the match or comes on as a substitute after the 1st goal has been scored. Own
goals do not count for either market. Subsequent appeals or rulings will not affect
settlement of the market. For "Player to Score" markets, all bets will stand if
the player plays any part in the match.
- 26.1.6 For markets that relate to the time of first or last goal, the first half is considered to last 45 minutes, regardless of additional time played. For these markets, a period will last from the first second to the time that falls one second before the end of the period so that, by way of example, the "0-10 minutes" selection covers the period from kick-off until 9.59. The "11-20 minutes" selection covers from 10.00 until 19.59. This principle applies to each of this type of market.
- 26.1.7 Markets relating
to the number of events that occur, such as the corners in match, will be decided
on the number taken, and not on the number awarded.
- 26.2 in running Football
– Managed games
At the start of the match, all unmatched bets, except for those selected to go in running, will be cancelled and the market will be turned in running. The market will be suspended if a “significant event” occurs (for example, a goal has been scored, a penalty awarded or a player being sent off , as determined by Betdaq in its sole discretion). If a goal is scored or a player is sent off, all unmatched bets, except for those selected as “Keep In-Running”, in running will be cancelled and the market re-opened. We endeavour to turn markets in running at the start of the game, match event (as applicable) but cannot guarantee that markets will be suspended or turned in running at the time stated within the Market Info Tab. If a market set to be turned in running does not do so at the stated time but is later turned in running within the duration of the game, match or event (as applicable) all bets matched prior to the “significant event” will stand. If a “significant event” has occurred without the game being turn in running, bets matched between the “significant event” in question and the market turned in running will be void. If a market set to be turned in running at the event start time fails to do so or is not suspended at any stage for the duration of the game, match event as applicable all bets matched after the official event start time will be void.
- 26.3 in running Football
– Unmanaged games
- 26.3.1 At the scheduled
start of the match, all unmatched bets, except for those selected to go in running,
will be cancelled and the market will be turned in running. Once in running, markets
will not be suspended, or unmatched bets will not be cancelled, at any time during
the game. Markets will be suspended 120 minutes after the scheduled start time.
- 26.3.2 In the event
of uncertainty regarding the result of any market, the determination of the relevant
football authority, as notified to Betdaq by the Press Association, will be used to determine
the outcome.
27. SWIMMING
All markets will be settled based on the official result at the time of the medals
presentation, regardless of subsequent amendments to the result. In the absence
of a medals presentation, bets will be settled in accordance with the first, official
result announced and regardless of subsequent amendments to the result.
28. TENNIS
- 28.1 If there is a change to the scheduled venue then all bets will stand and this includes any changes to the type of surface played on
- 28.2 Should a player or pairing fail to compete in an individual match or an event, all bets involving that player or pairing will be void. In the event of a match starting but not being completed, the player or pairing progressing to the next round (or winning the tournament in the case of a final) will be deemed the winner; unless, less than one set has been completed in which case all bets relating to that match will be void. This does not apply to ‘Match Odds’ or ‘Set Winner’ markets on Davis Cup matches or ‘dead rubber’ matches that have been shortened from five to three sets after the market has been opened by Betdaq, provided that the match has been shortened in accordance with the competition’s rules.
- 28.3 All bets relating to the number of occurrences of certain events within a tournament will be void if the tournament is reduced in length, postponed or cancelled, except for those on markets which have been unconditionally determined.
- 28.4 If the required number of games/sets to win a match changes in any way then all bets will be void, except for those on markets which have been unconditionally determined. This does not apply to ‘Match Odds’ or ‘Set Winner’ markets on Davis Cup matches or ‘dead rubber’ matches that have been shortened from five to three sets after the market has been opened by Betdaq, provided that the match has been shortened in accordance with the competition’s rules.
- 28.4 Should a player retire or be disqualified during a game or set within a match, all bets on game or set markets will be void except those on markets which have been unconditionally determined.
29. WINTER SPORTS
- 29.1 All markets will be
settled based on the official result at the time of the medals presentation, regardless
of subsequent amendments to the result. In the absence of a medals presentation,
bets will be settled in accordance with the first, official result announced and
regardless of subsequent amendments to the result.
- 29.2 If an event is postponed,
abandoned or interrupted all bets, except for those unconditionally determined, will be
void unless the event is completed within seven days or an official result is announced
by the governing body.
- 29.3 In Nordic Combined,
both skiers must start both sections of the event for bets to stand. For Ski Jumping,
one valid jump (including qualification) is enough for a competitor to achieve a
result for the event. Rules for other match bets and head to head markets will
be included in the Market Info Tab.
PART 4 PRIVACY POLICY AND COOKIE POLICY

- 1.1 We respect your right
to privacy and the BETDAQ Privacy Policy is designed to inform you of the methods
and purposes for which we gather and use your data. By visiting the BETDAQ Website,

- 1.2 All amendments shall automatically
be effective immediately they are posted on the BETDAQ Website. The continuing use
of the BETDAQ Website or the Services by a Customer following such modifications to
the Privacy Policy shall constitute acceptance of the new Policy and Customers will
be bound by such modifications. If a Customer does not accept any such changes, then
his/her sole remedy is to cease using the Services and withdraw any outstanding
Customer Account balance. You should print a copy of the Privacy Policy as amended

PART 5 MULTIPLE BET TERMS AND CONDITIONS
- 1. "Multiple Bets"
consist of a number of legs, where each leg is one or more selections from an individual
market or event. A maximum of seven selections can currently be combined in multiples,
although BETDAQ reserves the right to amend this number from time to time. All selections
in a Multiple Bet are subject to the BETDAQ Rules.
- 2. Certain combinations
of selections, including related contingencies, are not accepted and attempts to
place such bets may be prompted with an error pop-up at the bet submission stage.
If a bet of this type is inadvertently taken in error, BETDAQ reserves the right
to void the relevant, individual bet combinations.
- 3. If a selection in a
Multiple Bet is a non-runner or otherwise void under the BETDAQ Rules then all bets
on that leg of the multiple will be void and the Multiple Bet will be adjusted accordingly,
eg a treble becomes a double; a double becomes a single etc.
- 4. The minimum total Stake
for a multiple is £/€/$USD/$SGP1. The minimum total Stake per line is
£/€/$USD/$SGP0.05. For example, a 5 cent "Super Yankee" with 26 different
bets and a total Stake of €1.30 is allowed but a 4 cent "Super Yankee" would
not. Similarly, a 50 cent "Trixie" with a total Stake of €2 is allowed but
a 20 cent "Trixie" with a total Stake of only 80 cent would not. For currencies
other than Euro the minimum Stake may not equate; however, the calculations as described
above remain the same. The maximum payout from our Multiple Bet product, to any
one Customer on any one day's business is £/€/$USD/$SGP250,000.
- 5. Any Customer acting in
an attempt to defraud BETDAQ will have their Multiple Bets voided. BETDAQ reserves
the right void Multiple Bets in the case of egregious or obvious errors.
- 6. BETDAQ reserves the
right to void any or all bets made by any Customer acting in an attempt to defraud
the Company where there is any evidence of price, race, match or event rigging or
in the case of a rule breach applied by the governing body of the sport concerned.
Where such evidence exists of rigging or some other act which has unfairly affected
the result, or where there is evidence of a series of bets each containing the
same selection(s) having been placed by or for the same individual or syndicate
of individuals, BETDAQ reserves the right to make bets void or withhold payment
of returns pending the outcome of any subsequent investigation.
- 7. Not all markets available
will be available for multiple betting. BETDAQ reserves the right to determine
which markets will be made available for multiple betting. The odds available for
BETDAQ Multiple Bet will be derived from the exchange price for the corresponding
singles market.

PART 7. BETDAQ GAMES TERMS AND CONDITIONS
The BETDAQ Games product consists of a range of instant (non-downloadable) games
in full size and mini-embedded format, which can be played in Real Play and Fun
Play modes. "Real Play" involves gambling with real money whereas
"Fun Play" involves playing without the use of real money.
1. PLACING BETS ON
BETDAQ GAMES
- 1.1 You may bet up to the
amount deposited in your Customer Account by using one or more BETDAQ Games products.
- 1.2 You are obliged to check
that the bet instructions you submit are correct before confirming the bet.
It is your responsibility to ensure that any bet put forward by you reflects your
intentions and we do not accept responsibility for any mistakes you may make.
- 1.3 When a bet is offered
by you and accepted on a BETDAQ Games product, the corresponding amount is charged
against your Customer Account.
- 1.4 At all times, where there
is any disagreement as to the details of any bet Staked on a BETDAQ Games product
or the outcome of any bet, our electronic records (which are part of our regulated
and audited technical facilities) shall prevail.

2. VALID BETS ON BETDAQ
GAMES
- 2.1 Any proposition or other
information placed by us on any part of the BETDAQ Games service is not an offer
but is an invitation to Customers to put forward a bet transaction for acceptance
by us. A bet is deemed to be valid only following electronic confirmation of acceptance.
Only then is it recorded in our servers. This acceptance is demonstrated with the
generation of a game identification number as displayed within each game, or other
transaction or play reference.
- 2.2 You agree that the records
of BETDAQ Games shall be the final authority in determining the validity and terms
of any bets you place and the circumstances in which they were made.
- 2.3
We reserve the right to refuse all or any part of a bet offered to us, void any
accepted bet and withhold settlement for any reason justifying such refusal voiding
or withholding such as (but not only) if we have reason to believe:
- 2.3.1 You are under the
legal age for gambling in your country of residence;
- 2.3.2 You are involved in
any activity which in our discretion is illegal or unacceptable including fraud,
money laundering, collusion, bonus abuse, match rigging or cheating of any kind;
- 2.3.3 You are a resident
of or temporarily located in a jurisdiction that renders the provision of any BETDAQ
Games product to you or your use of it illegal.
- 2.4 We are only obliged to
pay out winnings that have been genuinely won in accordance with these BETDAQ Games
Terms and Conditions. All winnings will be credited to your Customer Account.

3. COMPUTER TRANSMISSIONS
AND RANDOM NUMBER GENERATOR
- 3.1 You fully accept that
BETDAQ Games and your interaction with it are dependent on the satisfactory operation
of computer systems and networks, including communications media, and that such
operation is not guaranteed to be available or accurate or satisfactory at all times.
- 3.2 You also accept that all
instructions and responses are sent between you and us and/or third parties over
the internet or by other connecting media over which neither you nor we have control
and that we do not accept any risk of malfunction or inadequacy in any way of connecting
media.
- 3.3 We will use all reasonable
endeavours to deal with any failure or malfunction of our own systems and to treat
Customers fairly in that respect and some of the consequences of such events (in particular
regarding interrupted play) are dealt with in the terms and Conditionsor applicable
game rules.
- 3.4 Our records shall be conclusive
evidence as to all transactions made with us both in relation to their nature and
value.
- 3.5 You fully accept and agree
that random number generator software will determine the outcome of bets on BETDAQ
Games (excepting any peer to peer games) and that the records of such software will
be final and conclusive in all respects.
- 3.6 Any client software supplied
to you or downloaded by you to enable or facilitate connection with BETDAQ Games
is regarded as your input software to BETDAQ Games and information delivered by
it will be binding on you.

4. BONUSES AND PROMOTIONAL
OFFERS
- 4.1 We may from time to time
offer or award you complimentary or bonus amounts to be credited into your Customer
Account. Bonuses may only be used in conjunction with BETDAQ Games specified when
the bonus is offered or awarded. Use of any bonus shall be in accordance with additional
terms and Conditionsof the relevant bonus offering or applicable promotional terms
and bonus release restrictions contained in the relevant offer or award.
- 4.2 Subject to the terms of
our Privacy Policy and applicable data protection laws we reserve the right to send
particular promotions to you. Promotional offers may have particular terms attached
to them and will only be available in accordance with the applicable terms of such
promotion.
- 4.3 Bonus offers and promotional
offers (unless expressed to be generally available) are intended for the addressed
recipient or category of persons only and cannot be transferred. If you are not
the intended recipient or you are not part of the intended category, then the offer
cannot be accepted by you.
- 4.4 You accept that it is

7. PLAY FOR FUN AND
PLAY FOR REAL MONEY
- 7.1 You may be able from time
to time to play the BETDAQ Games for Fun Play. If you Fun Play you may do so in
the "free play" or "play for fun" area only and no real monetary bet is necessary
or required to play and there is no real monetary win. There is no cost to you save
in respect to any cost you may incur to access the internet, charged by your internet
service provider or telecommunications provider.
- 7.2 If you Real Play you acknowledge
that a real monetary bet is required and that you may win or lose real money.
You are reminded that you accept full responsibility for any losses that you may
incur.
- 7.3 bets are only valid
if accepted by BETDAQ's server. Until that point all information displayed relating
to a game constitutes an invitation to play only. You agree that BETDAQ's records
shall be the final authority in determining the validity and terms of any bets
you place and the circumstances in which they were made. BETDAQ reserves the right,
at its sole discretion, to refuse or limit any bet you place. Where a bet is
invalid, refused or its value limited, any sum deducted from your account with respect
to that Stake will be credited to your account.

to note the payout rate or odds that apply to each BETDAQ Game before you place

- 7.5 When you play a BETDAQ
Game you agree to forfeit your bet and any winnings if you leave the BETDAQ Game
unfinished for a period of 90 days or more.

8. PAYOUTS
- 8.1 We reserve the right to
change the payout rates and odds of any of the BETDAQ Games at any time. You can
see the actual and any amended details by clicking on the "Info" icon on the right
hand side of each of the BETDAQ Games selectors. It is your responsibility to check
the payouts/odds on each occasion before you participate. The pay table for each
BETDAQ Game is available at all times within the game.
- 8.2 The maximum daily gross
win ("Maximum Win"), via your participation in the BETDAQ Games,
is limited to £/€/$USD/$SGP100,000 plus Stake (depending on your betting
currency). For the avoidance of doubt, the maximum daily amount per Customer that
BETDAQ will pay is limited to the aforementioned amounts. Any gross win plus Stake
in excess of the Maximum Win will be deemed to exceed these limits and will not
be paid out.
- 8.3 BETDAQ places a maximum
payout limit per BETDAQ Game ("Payout Limit") of £/€/$USD/$SGP25,000
(depending on your betting currency). BETDAQ hereby reserves the right to subject
all payouts in excess of the Payout Limit to a manual check before any remaining
win amounts in excess of the Payout Limit are paid out to you. BETDAQ will make
reasonable endeavours to conclude any such checks within 72 hours of the win occurring
and will not withhold any excess amount unreasonably.

9. INTERRUPTED GAMING
POLICY
- 9.1 If gaming is interrupted
(eg where your internet connection is disconnected) after you have successfully
placed a bet, BETDAQ's Games random number generator will continue to determine
the result of your bet on the relevant BETDAQ Game and will process the transaction
as would have occurred had the interruption not occurred (e.g. had your Internet
connection been live). You will be able to access details of the bet that was
determined when your play was interrupted by viewing your Customer Account statement
or requesting a copy of your betting history from the Customer support team.
- 9.2 If gaming is interrupted
(e.g. where your Internet connection is disconnected) whilst you are in the process
of placing a bet, our records will be definitive as to whether such bet was
successfully placed before the interruption occurred. If it was not successfully
placed the bet will be deemed a nullity.
- 9.3 Appropriate adjustments
will be made to your Customer Account to reflect the implementation of this policy.

10. DEFECTS AND MALFUNCTIONS
BETDAQ reserves the right to void any BETDAQ Game regardless of the state of completion
of the game if the game is found to be defective or suffers from any sort of malfunction.
Any defect or malfunction will render any winning bet null and void. If such a
defect or malfunction occurs, your Stake will be returned to you but not the winnings
that occurred at the time of defect or malfunction.

PART 7. RESPONSIBLE GAMBLING POLICY
We operate a responsible gambling policy and provide Customers with a variety of mechanisms
to assist them in controlling their gambling.
1. SETTING YOUR LIMITS
- 1.1 When you first register
and at any time thereafter, you are entitled to set a deposit and/or a Stake limit.
To set a limit, follow the instructions at the "My Account" section.
- 1.2 We will take all reasonable
precautions to ensure your limits are observed and we cannot override any limit
that you set without your consent. You can decrease your limits (e.g. lower your

2. SELF-EXCLUDING
- 2.1 Self-exclusion is offered

Customer Accounts or self-exclude for a defined period, without notice, at any time.
The minimum exclusion period is 6 months. During this time, a Customer's Account will
not be opened or utilised unless funds are to be withdrawn back to the Customer in

- 2.3 BETDAQ will endeavour
to close down all known Customer Accounts related to a self-excluded account for the

period you will be unable to access your Customer Account. We will make all efforts
